CAN AMERICANS CIVIL RIGHTS BE DETERMINED BY THE STATES THEY LIVE IN?

ANSWER: A BIG HELL NO!

This is is the question that has been weighing on my mind and I feel that this will ultimately be resolved by the Supreme Court in the Equal Protection case so perfectly set up by the DOMA ruling. You can’t have American citizens with different civil rights depending on which state they live in. America doesn’t work that way – period. Like interracial marriage, all states have to recognize interracial couples married outside of their state.

This is provided by Article IV, Section 1:

Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state. And the Congress may by general laws prescribe the manner in which such acts, records, and proceedings shall be proved, and the effect thereof.

While Texas and all inequality states feel they can ignore the United States constitution, they are in for a huge awakening!
